Our website designs, custom graphical design (online or offline) grant you non-exclusive limited license to use the web end product and other products sold through our websites in accordance with these Terms and Conditions (the "license") issued by our company. - a 9th Elevation Company, LLC. or a Ninth Commerce Group

a) Limited Usage Granted.
You may use each individual invoiced & paid in full product, offline design or media, on a "single website only", belonging to you. You must purchase an additional license in order to form another project with the same design or website design.

b) Modifications.
You are authorized to make any necessary modification(s) to our products to fit your purposes without removing or infringing upon a 9th Elevation Company, LLC. - a Ninth Commerce Group’s copyright. If you have any questions or concerns regarding what would be considered infringing upon our copyrights please do not hesitate to contact us. Please note that with the purchase of any website, a 9th Elevation Company, LLC. - a Ninth Commerce Group does not provide graphic source files used in the development of the product (such as psd’s and fla’s); furthermore some of the back-end code is encrypted and is not editable.

c) Unauthorized Use.
You can not place any of our products, modified or unmodified, on a website or any other medium to offer for redistribution or resale of any kind without prior written consent from a 9th Elevation Company, LLC. - a Ninth Commerce Group.

d) Assignability.
You may not sub-license, assign, or transfer this license to anyone else without prior written consent from a 9th Elevation Company, LLC. - a Ninth Commerce Group.

e) Ownership.
You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of a 9th Elevation Company, LLC. - a Ninth Commerce Group. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

f) Source Files Ownership.
The Client is the legal owner of the web site, custom layout graphics or designs (including all text, end files graphics ".jpg, .tif, .bmp, .gif, .tga. .png, .pict" and database contents) - (excluding source files: .fla, .ai, .psd, fcp, .net source files and database objects and structures). After we have received final payment for your project, you will own all the end files used to create your site or custom graphic online or offline designs. We protect proprietary source files that may contain licensed special fonts, custom one of a kind in house graphics, licensed vector graphics or trade secrets such as Flash ".fla" files, Photoshop ".psd" files. If you (Client), need these files (.ai, .psd, .fla. fcp, or similar raw or working files) the cost is 3 times the original project total fee or per the raw/working files original project invoice cost. We can/will negotiate special terms or fees for you to license the limited rights to the raw, working or source files on an individual usage basis or similar.

By using and purchasing from this website (or a 9th Elevation Company, LLC. Design Services) you agree to comply and agree with the following terms and conditions. Please make certain to read this and other documents regarding our policies on this website. If you do not agree with the terms put forth in this document you have no right to obtain information from or otherwise use this website. Failure to use this website in accordance with the following terms of use may subject you to severe civil and criminal penalties.

[2] What we may do to ensure that this policy is being followed

a) We may monitor your account but will respect your privacy. We may monitor the conduct of your account to determine whether this policy is being followed. If we monitor the conduct of your account we will safeguard your privacy unless to do so would involve us in concealment of a criminal offense or inhibit the enforcement of this policy.

b) We will make an effort to contact you. If we become concerned that your use of our service may break the law or that you have not complied with this policy we will attempt to contact you before taking action.

If we believe that your use of the service may break the law or that you have not complied with this policy we may: warn you by email; suspend your access to the service; terminate your account without notice; and/or notify and provide relevant information to the authorities, as appears appropriate in the circumstances.

d) In the event of taking action under 2.c, we reserve the right to delete any or all of your information, material, software or other content stored on our system in our sole discretion.
