Services – Terms and Condition

Thank you for your interest in our services. By appointing a 9th Elevation Company, LLC. you agree to be legally bound by these Terms and Conditions. Please read these terms carefully. If you do not accept these Terms and Conditions stated here without modification, you may not use the a 9th Elevation Company, LLC. services. a 9th Elevation Company, LLC. may revise these Terms and Conditions at any time by updating this posting.

Initial Concept Delivery

a 9th Elevation Company, LLC. will begin the design development process upon receiving the initial payment of 30%. The client will be notified by e-mail immediately upon payment confirmation, thus confirming the immediate start of the project. a 9th Elevation Company, LLC. will produce your initial concepts within the arranged amount days following the receipt of your payment.

Revision Cycles

Revision cycles generally consist of 3-5 additional compositions that incorporate changes requested by the client in the Revision Brief. The purpose of the revision process is to create Responses that move forward in a specific direction as determined by the client. The client may request significant changes in the 1st and 2nd cycles, and the Responses might be quite different in nature from the original composition chosen. By the 3rd revision request, the client's requests shall be modifications of the current composition only. Revision requests that depart from the current composition will be honored and completed in the same timely manner, however a 9th Elevation Company, LLC. reserves the right to charge $50 for each such Revision depending upon the complexity of the request or design needs. No revision work, which requires payment, will be started without authorization from the client.

Payment

Payment is made through a 9th Elevation Company, LLC. Merchant Account. We request a 30% deposit to start working; the rest is paid upon completion, unless other arrangements have been added and approved. In the case that the graphic files are digitally sent after final approval all payments will be settled prior to the files sent. a 9th Elevation Company, LLC. will wait for the payment to be confirmed before the project can officially start.

Refunds

Refunds are not normally available once the initial designs have been created and supplied to the client, but refunds for incomplete work will be considered at the discretion of the management. Should the client receive such refund, they acknowledge that they will have no right (express or implied) to use any response/samples or other work product, content, or media, nor any ownership interest in or to the same.

Project duration

The client agrees to provide timely responses to a 9th Elevation Company, LLC. after receiving status notifications from a 9th Elevation Company, LLC. The client shall have 30 days to respond to each set of Responses submitted to the client for review. If after 30 days the client has failed to so respond, a 9th Elevation Company, LLC. will assume the Project complete and the Project shall be deemed to be complete. At such time, a 9th Elevation Company, LLC. will have no further obligation to the client, and the clients Credit Card on File shall pay a 9th Elevation Company, LLC. all fees and expenses associated with work performed by a 9th Elevation Company, LLC.

Eligibility Requirements

To appoint a 9th Elevation Company, Inc., you much be at least 18 years of age, agree to these Terms and Conditions and the Disclosure Agreement. By appointing a 9th Elevation Company, Inc., you represent and warrant that you meet these eligibility requirements, that the information you include as part of the process is complete and accurate and, if you are utilizing a 9th Elevation Company, LLC. services on behalf of an entity, that you are authorized to bind that entity to these Terms and Conditions. a 9th Elevation Company, LLC. may accept or reject your utilization of a 9th Elevation Company, Inc.services in its sole discretion. The Service is not directed to children.

Trademarks and Service marks

a 9th Elevation Company, LLC. expects the client to perform researching on their company name to be sure the name is not already in use and securing a trademark or service mark to protect the client's legal rights to any name or image. a 9th Elevation Company, LLC. is not and will not be held responsible for any legal action that may result from improper due diligence on the availability of a company name or image.

Ownership/Copyrights

Ownership (copyright and title) of the final artwork will become the property of the client, having unlimited, indefinite, and royalty-free use of the image renderings (or Image Files Sent) upon payment of all fees. a 9th Elevation Company, LLC. retains rights to display the artwork in portfolio and advertising materials. All concepts, or other preliminary materials, which are not selected by the client or are not included into the final delivery, remain the full property of a 9th Elevation Company, LLC. The clients can purchase additional logo designs provided within the samples created.
